Terms of Service

1. The Service

SongMemory offers the creation of personalized songs generated with the help of artificial intelligence, based on the brief completed by the customer. The song is delivered in digital format (MP3) and includes an exclusive sharing page.

2. Plans and Delivery Times

Delivery times start counting after payment is confirmed. In cases of high demand or technical instability, the timeframe may be extended. The customer will be notified by email in case of delay.

3. Add-ons and Additional Services

In addition to the plans, we offer the following extras available for purchase:

Song on Streaming Platforms

Available as an add-on offer after the song is delivered. Includes distribution on streaming platforms (Spotify, Apple Music, Deezer and others). The publishing timeframe is approximately 25 days after the song is delivered, subject to approval by the distribution platforms. SongMemory does not guarantee approval by these platforms, as this is subject to each service's own policies.

Second Song

A second personalized song for another special person, with their own story, musical style and recipient. Purchased as an extra during the order process.

Gift Experience & Frameable Lyrics

Included at no extra cost with the VIP plan. On the Essential and Express plans, each can be purchased separately as a paid add-on during the order process.

• Gift Experience: An exclusive digital experience dedicated to the honoree, where they can listen to their personalized song, read the lyrics and experience receiving that gift in a special way.
• Frameable Lyrics: The song's lyrics formatted as an artistic PDF, ready to print and frame.

4. Refund and Revision Policy

When you're entitled to a refund or correction:

• An error on our part in creating the song (content outside the completed brief, errors in names, dates or information clearly described in the order).
• A technical failure that prevents the song from being delivered.

When there is no refund:

• Change of mind after the song has been delivered.
• Requests to change the brief after production has started (such as changing the recipient's name, musical style or occasion). In these cases, a new order must be placed.
• Adding content that wasn't in the original brief.
• Subjective dissatisfaction with the musical style chosen by the customer themselves.

Request deadline:

Refund or correction requests must be made within 30 days of the song's delivery, by email to hellosongmemory@gmail.com.

5. Intellectual Property

The song created is for the customer's exclusive personal use. SongMemory reserves the right to use fragments or examples of created songs (without identifying the customer) for promotional and portfolio purposes, unless the customer expressly requests otherwise.

6. Brief and Customer Responsibility

The quality of the generated song is directly related to the quality and clarity of the information provided in the brief. SongMemory is not responsible for unsatisfactory results resulting from incomplete, vague or contradictory briefs.

The customer is responsible for providing truthful information and for not infringing on third-party rights in the brief's content.

7. Data Privacy

The information provided in the brief (stories, memories, names) is used exclusively to create the requested song. We do not sell or share personal data with third parties, except with providers essential to the operation of the service (payment processing, email delivery, hosting).

8. Authenticity, Official Channels and Fraud Prevention

SongMemory takes measures to protect its customers against fraud attempts, cloned pages, fake profiles and unauthorized contacts. For the purposes of these Terms, the only official SongMemory site is https://songmemory.app, the only official contact email is hellosongmemory@gmail.com, and the only official Instagram profile is @songmemoryapp.

Any other domain, subdomain, social media profile, page, ad, message, email, phone number or contact that presents itself as SongMemory, without confirmation through the official channels indicated above, has no connection, authorization, representation or liability attributable to SongMemory or BG Tecnología.

SongMemory does not request payments through bank accounts, links or payment methods belonging to third parties, nor does it confirm orders outside the official site or official email. Payments, order confirmations, support communications and any request related to the service must be made exclusively through the brand's official channels.

Before making any payment or sharing personal data, the user must verify that they are accessing the official URL indicated in these Terms. SongMemory is not responsible for payments, transactions, data disclosure, losses or damages resulting from fake sites, cloned pages, fraudulent profiles, misleading ads or unofficial contacts that improperly use the SongMemory name, visual identity or brand.

9. Limitation of Liability

SongMemory is not responsible for:

• Indirect or consequential damages arising from use of the service.
• Delays caused by instability in third-party services.
• Non-approval of songs by streaming platforms under the Song on Streaming Platforms add-on.
• Transactions, payments or data disclosure made on fake sites, cloned pages, fraudulent profiles or unofficial contacts.

10. Changes to the Terms

SongMemory may update these terms periodically. In the event of significant changes, we will notify you by email or a notice on the site. Continued use of the service after such changes constitutes acceptance of the new terms.
